1. Acceptance
By downloading, installing or using KINH Metronome ("the app"), you agree to these terms. If you do not agree, please do not use the app.
2. Licence to use
The app is provided free of charge. We grant you a personal, worldwide, royalty-free, non-exclusive and non-transferable licence to install and use it on devices you own or control. You may use it for any purpose, personal or professional, including teaching, rehearsal, performance and recording.
3. What you may not do
You may not sell, rent or sublicense the app itself, remove or alter any attribution or branding within it, or redistribute modified copies as though they were the original. Nothing here restricts rights you have under applicable law, including any right to reverse engineer for interoperability.
4. No warranty
The app is provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that its timing will be accurate enough for any particular use. It is a practice tool and should not be relied on where precise timing is critical.
5. Limitation of liability
To the fullest extent permitted by law, KINH Tech is not liable for any indirect, incidental, special or consequential damages, or for any loss of data, revenue or profits, arising out of your use of or inability to use the app. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, where such limitation is prohibited.
6. Intellectual property
The app, its source code, name, logo, visual design and sounds remain the property of KINH Tech and its licensors. These terms grant you a licence to use the app, not any ownership of it.
7. Third-party terms
The app is distributed through Google Play, and your use of that service is governed by Google Play's Terms of Service in addition to these terms.
8. Availability and changes
We may update, change or discontinue the app, or any part of it, at any time and without notice. We may also revise these terms; if we do, we will update the effective date above. Continuing to use the app after a change means you accept the revised terms.
9. Privacy
The app collects no personal data. See the Privacy Policy for details.
10. Governing law
These terms are governed by the laws of the United Mexican States. Any dispute will be subject to the competent courts of Puebla, Mexico, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence.
